9. Data Transfer Outside the EU/EEA

At VOS| Virtual Operative Services, we understand the importance of ensuring the security and protection of your data, especially when it involves cross-border transfers. While our user data and payments are processed and stored on cloud servers within the United States (US) or European Union (EU) to uphold the high standards of data protection, we also have Virtual Operatives (V.O’s) based in South Africa.

The decision to have V.O’s located in South Africa is strategic, aimed at providing you with optimal services while maintaining an optimal pay-rate for you, our users. As a result, there are instances where data accessed by our V.O’s, based in South Africa, may involve cross-border transfers from the US, or EU/EEA to South Africa.

We want to assure you that these cross-border transfers are carried out with a focus on data encryption and security. We take measures to ensure that any data transfers are conducted in compliance with applicable data protection regulations. Safeguards are implemented to protect your data during transit and maintain the level of security expected under the General Data Protection Regulation (GDPR).

Our V.O’s based in South Africa are essential for delivering the high-quality on-demand admin services you expect from us. While their location might involve data transfers outside the EU/EEA, we uphold the same commitment to data security and protection throughout these processes.

Some of the processes taken to secure your data are:

  1. Using standard contractual clauses (SCCs): SCCs are a set of pre-approved contractual clauses that can be used to ensure that personal data is protected when it is transferred to a country outside of the EEA. SCCs are approved by the European Commission and are legally binding.
  2. Using binding corporate rules (BCRs): BCRs are internal rules that can be adopted by a group of companies to govern the transfer of personal data within the group. BCRs must be approved by the relevant data protection authorities and must be enforceable by individuals.
  3. Using other appropriate safeguards: In addition to SCCs, BCRs, and adequacy decisions, there are a number of other safeguards that can be used to protect user data when it is transferred to a country outside of the EEA. These safeguards may include:
    • Encrypting the data before it is transferred
    • Using a trusted third party to transfer the data
    • Only transferring the data to countries that have a good reputation for data protection

If you have any questions or concerns about the data transfer outside the EU/EEA or the measures we have in place to safeguard your data during these transfers, please do not hesitate to contact us at [info@virtualopservices.com]. Your trust and confidence in our services remain our utmost priority.

We strive to ensure that you have a clear understanding of how your data is handled and the purposes for which it is processed.

Limited Responsibility: While we take comprehensive measures to protect your data and maintain its security, it’s important to note that certain responsibilities lie with you as a user. You are responsible for maintaining the confidentiality of your account credentials and ensuring the security of your device. We encourage you to use strong passwords, implement device security measures, and promptly report any unauthorized access to your account.

We will always have a lawful basis for processing your data, as outlined in our Privacy Policy. This basis may include your consent, the necessity to fulfill a contract, compliance with a legal obligation, protection of vital interests, or the performance of a task carried out in the public interest.

13. Consent

Where we rely on your consent as the lawful basis for processing your data, we will obtain your explicit and informed consent. You have the right to withdraw your consent at any time, and we will make this process clear in our Privacy Policy.
